1. Acceptance of Terms
FunAI ("FunAI," "we," "us," or "our") is an AI creative platform offering image generation, image editing, video generation, and related tools (the "Service"). These Terms and Conditions ("Terms") form a binding agreement between you and FunAI and govern your access to and use of the Service.
By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization. You are responsible for ensuring everyone accessing the Service through your account complies with these Terms.
Certain features may be governed by additional terms ("Supplemental Terms"), which are incorporated into this agreement. Where Supplemental Terms conflict with these Terms, the Supplemental Terms control for that feature.
2. Eligibility and Accounts
You must be at least 13 years old, or the minimum digital age of consent in your country if higher. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian who accepts these Terms on your behalf.
Most features require an account. You agree to:
- Provide accurate and current registration information and keep it updated.
- Keep your login credentials confidential and use a strong, unique password.
- Accept responsibility for all activity that occurs under your account.
- Notify us promptly of any unauthorized access or suspected security breach.
Accounts are personal to you. You may not share, sell, or transfer your account, register multiple accounts to circumvent usage limits, or misrepresent your identity or affiliation. We may suspend or close accounts we reasonably believe are being shared or misused.
Because outputs are produced by AI systems responding to user input, we cannot guarantee that generated content will meet every user's expectations of accuracy, style, or appropriateness.
3. Plans, Credits, and Billing
- Plans. FunAI offers free access with limited features or quotas, and paid plans with higher limits and additional tools. Current pricing, inclusions, and credit allowances are shown on our pricing page or in-app.
- Credits. Certain operations consume credits. Credits are valid only within the Service, may expire as stated at the time of purchase or in your plan, are not redeemable for cash, and are not transferable unless a specific team or business plan permits it. Unused credits are forfeited on account closure, except where the law requires otherwise.
- Payment and renewal. Paid plans are billed in advance and renew automatically at the end of each billing cycle at the then-current rate, until cancelled. By subscribing you authorize us and our payment processor to charge your payment method each renewal period, plus applicable taxes. We will give reasonable advance notice of material price or feature changes; continued use after they take effect constitutes acceptance.
- Free trials. Where offered, trials run for the stated period. If a payment method is required and you do not cancel before the trial ends, the trial converts to a paid subscription and billing begins. We may modify or withdraw trial offers at any time.
- Cancellation and refunds. You may cancel at any time from your account settings or through the platform where you purchased. Access continues until the end of the current billing period; the plan then does not renew. Downgrades take effect at the next billing period. Fees and credit purchases are non-refundable except where required by law or stated in our refund policy.
- Failed payments. If a charge fails, we may retry, notify you, and suspend, downgrade, or terminate your plan if payment remains outstanding. You remain liable for unpaid amounts.
4. Availability and Changes to the Service
The Service is under active development. We may add, change, or remove features at any time. If a change materially reduces core functionality of a paid plan, we will make reasonable efforts to notify you or offer an adjustment.
Features labelled beta, preview, or experimental are provided as-available for testing, without warranties, and may change or be withdrawn at any time.
We do not guarantee uninterrupted or error-free operation, and the Service may be unavailable for maintenance, upgrades, or reasons outside our control. Please do not rely on the Service for time-critical or mission-critical purposes.
5. Acceptable Use
You agree to use the Service lawfully and in line with these Terms. You are responsible for all inputs you submit and all outputs you generate, use, or distribute (together, "Content").
You must not:
- Break the law. Use the Service for unlawful, fraudulent, or malicious purposes, or submit content that is illegal where you live or where we operate.
- Infringe rights. Submit or generate content that infringes anyone's copyright, trademark, patent, trade secret, publicity, or privacy rights, including prompts designed to reproduce protected works without authorization.
- Generate prohibited content. Create or distribute sexually explicit material, content sexualizing minors, gratuitous gore, hate speech, harassment, content promoting self-harm, terrorism, or extreme violence, or defamatory or discriminatory material.
- Misuse other people's likeness or data. Upload images or media depicting other people without their permission, upload material depicting minors inappropriately, submit sensitive personal data about others, or publish another person's private identifying information.
- Deceive. Produce deepfakes, impersonations, phishing material, or other content intended to mislead, defraud, or cause harm, or misrepresent the origin of generated content where doing so is likely to cause confusion or damage.
- Engage in political manipulation. Use the Service to produce misleading election or campaign material, or to manipulate political outcomes.
- Spam. Send unsolicited advertising, bulk messaging, or solicitations, or scrape contact information.
- Interfere. Attempt to hack, overload, disrupt, or bypass security or rate limits, or access the Service by automated means other than our official API.
- Reverse engineer or compete. Decompile, reverse engineer, or attempt to extract source code, model weights, or underlying systems, or use the Service or its outputs to develop, train, or benchmark a competing product. You may not resell or provide unauthorized third-party access to the Service.
- Abuse community features. Where content sharing is available, follow any community guidelines, do not repost others' work as your own, and do not harass other users.
We may, but are not obliged to, monitor use of the Service. We may refuse to process any input, filter or remove any content, and suspend or terminate accounts that violate these Terms — with or without prior notice in serious cases. We may also cooperate with law enforcement where required.
To report misuse, contact us using the details in Section 16.
6. Content and Intellectual Property
6.1 Your Inputs and Outputs
Inputs. You represent that you own or have all necessary rights, licenses, and permissions for any prompt, image, video, audio, or other material you submit, and that submitting it and generating from it will not infringe anyone's rights or breach any confidentiality obligation.
Outputs. Subject to your compliance with these Terms and payment of applicable fees, we assign to you or grant you the broadest license we are able to grant in the outputs you generate. Ownership of AI-generated material is treated differently across jurisdictions, and in some places such material may not be eligible for copyright protection at all. We make no representation that outputs are protectable or exclusive to you — similar outputs may be generated by other users from similar prompts.
Personal vs. commercial use. Unless stated otherwise, outputs generated on free or trial plans are for personal, non-commercial use. Paid plans permit commercial use, subject to these Terms and applicable law.
Your responsibility. You are solely responsible for how you use and distribute outputs. If an output resembles or incorporates protected third-party material, you may need separate permission before using it. We recommend reviewing outputs carefully before commercial use.
6.2 Licenses You Grant Us
To operate the Service. You grant FunAI a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, transmit, and display your Content solely as needed to operate, secure, support, and deliver the Service to you.
AI training. We will not use your prompts, uploads, or generated content to train or fine-tune AI models without your consent. Where we offer an opt-in for this, it is disabled by default and you may withdraw it at any time; withdrawal does not reverse training already performed.
Public content. If you publish content to a public gallery, feed, or community area, you grant us and other users a license to view, display, and — where the feature allows — remix that content. We indicate which areas are public. Keep private what you do not want seen.
Feedback. Suggestions or ideas you send us may be used freely, without obligation or compensation, and create no confidentiality obligation.
6.3 Our Intellectual Property
All rights in the Service — including software, models, interfaces, designs, documentation, the FunAI name and logos, and all related intellectual property — remain ours or our licensors'. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes, subject to these Terms. You may not use our branding without written permission. Third-party and open-source components included in the Service may carry their own license terms. All rights not expressly granted are reserved.
7. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information, and is incorporated into these Terms by reference. Where the Privacy Policy and these Terms conflict on personal data matters, the Privacy Policy controls. Content you make public is not private and may be seen and used by others.
8. Copyright and IP Complaints
We respect intellectual property rights and expect users to do the same.
Takedown notices. If you believe content on the Service infringes your rights, send a written notice to [email protected] including:
- Identification of the work you claim is infringed.
- Identification and location of the allegedly infringing material.
- Your name, address, phone number, and email.
- A statement of good-faith belief that the use is unauthorized.
- A statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them.
- Your physical or electronic signature.
We will review valid notices promptly and may remove or disable access to the material, notify the user who posted it, and allow a counter-notification.
Counter-notices. If your content was removed by mistake, send us a counter-notice identifying the material and its location, a statement under penalty of perjury of your good-faith belief that removal was an error, and your contact details.
Repeat infringers. We terminate the accounts of repeat infringers in appropriate circumstances, and may act on a first offence where warranted.
Trademarks. Report suspected trademark misuse to the same address with details of your mark, the disputed use, and proof of your rights.
9. Disclaimers
The Service and all content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will meet your requirements, operate without interruption or error, or that outputs will be accurate, original, non-infringing, or suitable for your purposes. AI systems are probabilistic; safety filters may not catch every prohibited result. You use the Service and any output at your own risk.
We do not guarantee that your content will be retained indefinitely or will be recoverable — keep your own backups of anything important. Third-party services accessible through the Service are governed by their own terms, and we are not responsible for them.
Some jurisdictions do not allow certain disclaimers; in those places our warranties are limited to the minimum extent the law requires.
10. Limitation of Liability
To the fullest extent permitted by law, FunAI and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, goodwill, or data, arising from or related to your use of or inability to use the Service — even if we were advised such damages were possible.
Our total aggregate liability for all claims relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud, wilful misconduct, or death or personal injury caused by negligence.
11. Indemnification
You agree to defend, indemnify, and hold harmless FunAI, its parent and affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, and reasonable legal costs arising from: (a) your Content or use of the Service; (b) your breach of these Terms; (c) your violation of any law; or (d) your infringement of any third party's rights.
We may assume exclusive defence and control of any such matter at our own expense, in which case you agree to cooperate. You will not settle any claim in a way that admits liability on our behalf or affects our rights without our written consent. This obligation does not apply to the extent a claim arises from our own gross negligence, wilful misconduct, or fraud, and it survives termination.
12. Termination
By you. You may stop using the Service at any time and delete your account through your settings or by contacting support. Deletion may take a short processing period to complete.
By us. We may suspend or terminate your access, in whole or in part, with or without notice, if you breach these Terms, if your use creates legal or security risk, or if we discontinue the Service. For minor issues we will generally try to warn you first, but we are not required to.
Effect. On termination, your licenses end, you must stop using the Service, and your content may no longer be accessible to you — save anything important in advance. Content you made public may remain visible. Provisions that by their nature should survive — including IP, disclaimers, liability limits, indemnification, and dispute resolution — will survive.
If we terminate your account for a violation, you may not create a new one, and we may block re-registration. You may appeal by contacting us, but reinstatement is not guaranteed.
13. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which FunAI's operating entity is registered, without regard to conflict-of-law rules.
The parties will first attempt in good faith to resolve any dispute informally within thirty (30) days of written notice. If it remains unresolved, it will be finally settled by binding arbitration or the exclusive jurisdiction of the courts of that jurisdiction, conducted in English. Either party may seek injunctive relief from a competent court to protect its rights in the meantime. Each party bears its own legal costs unless otherwise awarded.
If you are a consumer resident outside that jurisdiction, nothing here deprives you of the protection of mandatory consumer laws of your country of residence.
14. Changes to These Terms
We may update these Terms. For material changes we will post the revised version with a new "Last updated" date and, where appropriate, notify you by email or in-app. Changes take effect on posting unless stated otherwise. Continuing to use the Service after that means you accept the updated Terms; if you do not, stop using the Service and cancel any subscription.
15. General
- Entire agreement. These Terms, any Supplemental Terms, and the Privacy Policy are the whole agreement between us regarding the Service and supersede prior understandings.
- No waiver. Failure to enforce a provision is not a waiver of it.
- Severability. If a provision is held unenforceable, it will be limited or severed and the rest remains in effect.
- No agency. These Terms create no partnership, employment, franchise, or agency relationship.
- No third-party beneficiaries. Except as expressly stated, no third party may enforce these Terms.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, excluding payment obligations.
- Notices. We may give notice by email, in-app, or by posting on our website; you consent to electronic communications. Notices to us go to the address in Section 16.
- Interpretation. Headings are for convenience only. "Including" means "including without limitation." The English version of these Terms controls over any translation.
