1. Scope
This Policy applies to everyone who uses FunAI, wherever they are located, including users in the United States, the European Union and EEA, the United Kingdom, and other jurisdictions with their own data protection laws. Where local law gives you additional rights, those rights apply to you in addition to what is written here.
2. Information We Collect
- Account and contact details. Your name, email address, username, password credentials, billing address, and the plan you are subscribed to. If you sign in with a third-party provider such as Google, we receive your basic profile details and email address from that provider.
- Payment information. Payments are handled by our third-party payment processor. Card numbers and full financial details are collected and stored by the processor, not by us. We retain only transaction records such as amounts, dates, plan details, and confirmation identifiers.
- Content you provide and create. Text prompts, reference images, videos, audio, and any other files you upload, along with the outputs generated from them and the settings and metadata describing how each item was produced.
- Usage and device data. IP address, browser and device type, operating system, referring pages, pages viewed, features used, timestamps, credit consumption, and diagnostic or crash reports.
- Cookies and similar technologies. Session identifiers, device identifiers, and analytics data collected through cookies, pixels, local storage, and comparable technologies.
- Communications. The content of messages you send us through support tickets, email, feedback forms, or surveys.
3. How We Use Your Information
We use the information described above to:
- Provide the Service — process your generation and editing requests, deliver outputs, and store your work in your account.
- Create and manage your account, authenticate you, and keep your credit balance accurate.
- Process payments, renewals, refunds, and related accounting.
- Send service messages such as security alerts, billing notices, and product or policy updates.
- Send marketing communications where you have opted in; you can unsubscribe at any time.
- Analyze usage patterns to maintain, debug, secure, and improve the Service.
- Detect, investigate, and prevent fraud, abuse, and violations of our Terms or content rules, including review of generated content for prohibited material.
- Comply with legal obligations and enforce our agreements.
We do not sell your personal information, prompts, uploads, or generated content.
4. Legal Bases (EU, EEA, and UK Users)
Where GDPR or UK GDPR applies, we rely on the following legal bases:

You may withdraw consent at any time. Withdrawal does not affect processing carried out before you withdrew.
5. AI Model Providers
FunAI generates content using a combination of our own infrastructure and AI models operated by third-party providers. To fulfil a request, your prompt and any reference files you supply are transmitted to the relevant model provider so a result can be returned.
Please do not include personal, confidential, or sensitive information in your prompts or uploads. Only upload photographs of yourself or of people who have given you permission.
6. Sharing and Disclosure
We share information only in the following circumstances:
- Service providers. Cloud hosting, storage, content delivery, authentication, payment processing, email delivery, customer support, and analytics vendors, acting on our instructions and bound by confidentiality obligations.
- AI model providers. As described in Section 5.
- Public and community features. If you choose to publish work to a public gallery or community feed, that content and your display name become visible to others. Do not publish anything you want to keep private.
- Analytics and advertising partners. Aggregated or de-identified usage data, where permitted and subject to your cookie choices.
- Legal and safety. Where required by law, valid legal process, or where necessary to protect our rights, our users, or the public.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy continuing to apply.
7. How Generated Content Is Stored and Shared
Your uploads and generated files are stored on our storage and content delivery infrastructure and served from unique, randomly generated URLs. These URLs are not published, indexed, or listed publicly, but anyone holding a URL can open the file without signing in. Treat these links as private and share them only with people you intend to have access. Deleting an item from your account revokes access through its link.
8. Data Retention
We keep personal information only as long as necessary for the purposes described in this Policy.
- Account and profile data: for as long as your account is active.
- Generated content and uploads: until you delete them or delete your account.
- Billing and transaction records: for the period required by tax and accounting law.
- Logs and technical data: for a shorter period, unless needed for security investigations or legal compliance.
When you delete your account, we delete or anonymize your personal information, except records we are legally required or have a legitimate need to retain.
9. Your Rights and Controls
Subject to applicable law, you may:
- Access the personal information we hold about you and request a copy in a portable format.
- Correct inaccurate or incomplete information.
- Delete your personal data and your account.
- Restrict or object to certain processing, including direct marketing.
- Withdraw consent where processing is based on consent.
- Lodge a complaint with your local data protection authority.
Much of this can be done directly from your account settings. For anything else, contact us at the address in Section 16. We will verify your identity and respond within the time frame required by law.
11. Cookies
We and our partners use cookies and similar technologies to keep you signed in, remember your preferences, measure traffic, and improve the Service. You can manage or disable cookies through your browser settings or, where offered, our cookie preference tool. Disabling certain cookies may prevent parts of the Service from working properly.
12. Security
We apply industry-standard technical and organizational measures — including encryption in transit, access controls, and monitoring — to protect your information against unauthorized access, disclosure, alteration, and loss. No method of transmission or storage is completely secure, so while we work to protect your data, we cannot guarantee absolute security. Please use a strong, unique password and notify us immediately if you suspect unauthorized access to your account.
13. Children's Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from them. Where local law sets a higher age of digital consent, that age applies. If we learn that a child has provided us with personal information, we will delete it. Parents or guardians who believe a child has used the Service may contact us to request removal.
14. International Transfers
We may process and store information in countries other than the one in which you live. Where we transfer personal data out of the EEA or UK, we rely on appropriate safeguards such as Standard Contractual Clauses or an adequacy decision.
15. Changes to This Policy
We may update this Policy to reflect changes in our practices, technology, or legal requirements. When changes are significant, we will post the updated version with a revised "Last updated" date and, where required, notify you by email or in-product notice. Continued use of the Service after an update means you accept the revised Policy.
